Welcome! This Privacy Policy explains how Project Giving Kids, Inc. (“PGK”, “we”, or “us”) collects, uses, and discloses information about you when you use: interactive features, widgets, plug-ins, applications, content, downloads, and/or other services that we own and control and make available; access or use our websites, mobile applications, and other online products and services that link to this Privacy Policy (collectively, the “Services”); contact our team; engage with us on social media; or otherwise interact with us. This Privacy Policy does not apply to our data collection activities offline, or otherwise outside of our Services (unless otherwise stated below), and does not govern the data practices of third parties that may interact with our Services.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). We encourage you to review the Privacy Policy whenever you access the Services or otherwise interact with us to stay informed about our information practices and the choices available to you.

In addition, please review the Services’ Terms of Service, which governs your use of the Services. By using our Services, you consent to our Privacy Policy and Terms of Service and our collection, use, and sharing of your information and data, and other activities, as described below.

1. Collection of Information

A. INFORMATION YOU PROVIDE TO US

Personal Information and Demographic Information. We collect information you provide directly to us. We may ask you to provide us with certain categories of information depending on whether you are a user or an organization (like a school or non-profit partner). As a user, we may ask you for: (1) personally identifiable information, such as your first and last name, email address, date of birth, zip code and (2) demographic information, such as information about your gender and age (“Demographic Information”). You may also provide us with your service activity and service history. From non-profit organizations we partner with, schools, and youth-serving organizations, we may also ask for your first and last name, email address, date of birth, zip code, point-of-contact information - including title or position, and phone number (“Personal Information”). We may collect this information through various forms and in various places through the Services, including account registration forms, or when you otherwise interact with the Services. To the extent we combine Demographic Information with your Personal Information we collect directly from you on the Services, we will treat the combined data as Personal Information under this Privacy Policy.

Non-profit organizations we partner with, schools, and youth-serving organizations may provide volunteer opportunity descriptions, organizational contact information, logos and other images, and other organizational information. The information and data provided are those of the organizations and PGK does not endorse them, nor is responsible for the accuracy or completeness of the provided data. We retain the right to modify, update, designate as inactive, or remove that data at any time.

B. INFORMATION COLLECTED OR STORED AS YOU ACCESS AND USE THE SERVICES

We collect information about your use of the Services when we and our third-party service providers use a variety of technologies that automatically (or passively) store or collect certain information whenever you visit or interact with the Services (“Usage Information”). This Usage Information can be stored or accessed using a variety of technologies that can be downloaded to your personal computer, browser, laptop, tablet, mobile phone, or other device (a “Device”) whenever you visit or interact with our Services. To the extent we associate Usage Information with your Personal Information we collect directly from you on the Services, we will treat it as Personal Information.

C. AUTOMATICALLY COLLECTED INFORMATION

When you access or use our Services, we automatically collect information about you, including the URL that referred you to our Services, the areas within our Services that you visit, and your activities there, including remembering you and your preferences, your Device characteristics, and certain other Device data (like time of day).

We also collect:

Log and Usage Information. We collect information related to your access to and use of the Services, including the type of browser you use, app version, access times, pages viewed, your IP address, and the page you visited before navigating to our Services.

Device Information. Information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers, and mobile network information may be collected from third parties, including Google Analytics. PGK does not collect this information.

Location Information. We may derive the approximate location of your device from your IP address.

Information Collected by Cookies and Similar Tracking Technologies. We (and our service providers) use different technologies to store or collect Usage Information, including cookies and web beacons (“Tracking Technologies”). Tracking Technologies may set, change, alter or modify settings or configurations on your Device. A few of the Tracking Technologies include, without limitation, the following (and include subsequent technology and methods later developed):

Cookies.Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. A Flash cookie (or locally shared object) is a data file placed on a Device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device. HTML5 cookies can be programmed through HTML5 local storage. Unlike Flash cookies, HTML5 cookies do not require a plug-in. Regular cookies may generally be disabled or removed by tools that are available as part of most commercial browsers, and in some, but not all, instances can be blocked in the future by selecting certain settings. Each browser you use will need to be set separately and different browsers offer different functionality and options in this regard. Also, these tools may not be effective with regard to Flash cookies or HTML5 cookies. For information on disabling Flash cookies, go to Adobe’s web site www.adobe.com. Please be aware that if you disable or remove cookies, Flash cookies, or HTML5 cookies on your Device, some parts of our Services may not function properly, and that when you revisit our Services your ability to limit cookies is subject to your browser settings and limitations.

Web Beacons. Web beacons (also known as “pixel tags” or “clear GIFs”) or similar technologies are electronic images that may be used in our Services or emails and may be used for a number of purposes, including, without limitation, to help deliver cookies, count visits, understand usage, monitor how users navigate the Services, count how many emails sent were actually opened, or count how many particular articles or links were actually viewed. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or e-mail can act as a web beacon.

We may use Tracking Technologies for a variety of purposes, including:

Strictly Necessary. We may use cookies or other Tracking Technologies that we consider are strictly necessary to allow you to use and access our Services, including cookies required to prevent fraudulent activity or improve security.

Performance-Related. We may use cookies or other Tracking Technologies that are useful in order to assess the performance of the Services, including as part of our analytic practices or otherwise to improve the content, products, or services offered through the Services.

Functionality-Related. We may use cookies or other Tracking Technologies that are required to offer you enhanced functionality when accessing the Services, including identifying you when you sign-in to our Services or keeping track of your specific preferences, including the presentation of content on our Services.

Targeting-Related. We may use Tracking Technologies to deliver content, including ads, relevant to your interests on our Services and third-party sites, based on how you interact with our advertisements or content. This includes using Tracking Technologies to understand the usefulness of the advertisement or content that has been delivered to you.

There may be other Tracking Technologies now and later devised and used by us in connection with the Services. Further, third parties may use Tracking Technologies in connection with our Services, which may include the collection of information about your online activities over time and across third-party websites or online services. We do not control those Tracking Technologies and we are not responsible for them. However, you consent to potentially encountering third-party Tracking Technologies in connection with our Services and accept that our statements under this Privacy Policy do not apply to the Tracking Technologies or practices of such third parties. Also, various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party websites or online services (e.g., browser do not track signals). Currently, we do not monitor or take any action with respect to these signals or other mechanisms.

D. INFORMATION THIRD PARTIES PROVIDE ABOUT YOU

We may also obtain information we receive about you from your friends and others that use the Services, such as when they submit content to us or post on the Services. If you create or log into your account through a social media site, we will have access to certain information from that site, such as your full name and username, in accordance with the authorization procedures determined by such social media site.

PGK may collect information about you from third parties, including but not limited to mailing list providers and publicly available sources. Additionally, we may, from time to time, supplement the information we collect directly from you on our Services with outside records from third parties for various purposes, including to enhance our ability to serve you, to tailor our content to you, and to offer you opportunities that may be of interest to you.

To the extent we combine information we receive from those sources with your Personal Information we collect on the Services, it will be treated as Personal Information and we will apply this Privacy Policy to such combined information, unless we disclose otherwise. In no other circumstances do our statements under this Privacy Policy apply to information we receive about you from third parties.

E. INTERACTIONS WITH THIRD-PARTY SERVICES

The Services may include functionality that allows certain kinds of interactions between the Services and a third-party website or application. In addition, we may provide third-party sites’ interfaces or links on the Services to facilitate your sending a communication from the Services. For example, we may use third parties to facilitate emails, tweets, or Facebook postings. These third parties may retain any information used or provided in any such communications, or other activities. Please note: these third parties’ practices are not subject to our Privacy Policy. PGK does not control or have access to your communications through these third parties. Further, when you use third-party sites or services, you are using their services and not our services and they, not we, are responsible for their practices. You should review the applicable third-party privacy policies before using such third-party tools on our Services.

2. Use of Information

Use of Information by Us. We may use your Personal Information, Demographic Information or Usage Information that is subject to this Privacy Policy to:

  1. Provide, maintain, and improve our products and services;
  2. Process your registration with the Services, including verifying your information is active and valid;
  3. Share, at your election and discretion, your service history and activities with those individuals or organizations (like your school) that you want us to notify and share your information with;
  4. Populate our website (only applicable to non-profits’ or organizations’ non-personal information);
  5. Send you technical notices, updates, security alerts, support and administrative messages, and to respond to your comments, questions, and customer service requests;
  6. Communicate with you about products, services, and events offered by PGK and others, and provide news and information we think will be of interest to you including electronic newsletters, special offers, or promotional materials on behalf of us or our third parties. (see Your Choices below for information about how to opt-out of these communications at any time);
  7. Monitor and analyze trends, usage, and activities in connection with our Services;
  8. Detect, investigate, and prevent fraudulent transactions and other illegal activities, and protect the rights and property of PGK and others;
  9. Personalize your online experience and the advertisements you see when you use the Services or third-party platforms based on your preferences, interests, browsing, and behavior;
  10. Facilitate contests and promotions and process and deliver entries and rewards; and
  11. Carry out any other purpose described to you at the time the information is collected.

When it comes to non-profit users, schools, and youth-serving programs, we only use your Personal Information to contact you: about your organizational profile and the information listed on our platform, to add you to our relevant newsletter lists, and contact you with information regarding related content that may be of interest to you.

3. Sharing of Information

We do not share your Personal Information. This includes any information collected directly from you on our Services. We will honor your sharing choices at the time you provide your Personal Information, based on your consent.In addition, we may share the information we have collected about you, including Personal Information, as disclosed at the time you provide your information and as described below or otherwise in this Privacy Policy. We may also share aggregated or de-identified information that cannot reasonably be used by third parties to identify you.

PGK may share information about you as follows:

A. WHEN YOU REQUEST INFORMATION FROM OR PROVIDE INFORMATION TO THIRD PARTIES

You may be presented with an option on our Services to receive certain information and/or marketing offers directly from third parties, or you may have us send certain information to third parties or ask us to give them access to certain information - if you choose to do so, your Personal Information and other information may be disclosed to such third parties and all the information you disclose will be subject to the third-party’s privacy policies and practices.

Third parties may store, collect, or otherwise have access to your information when you interact with their Tracking Technologies, content, tools, apps, or ads on our Services. This may include using third-party tools such as Facebook, Twitter, Pinterest, or other third-party posting or content-sharing tools. By so interacting, you consent to such third-party practices. We are not responsible for the privacy policies and practices of such third parties, therefore, you should review such third-party privacy policies and practices of such third parties prior to requesting information from, or otherwise interacting with them.

B. WHEN NON-PROFIT PARTNERS AND THIRD PARTIES PROVIDE SERVICES ON OUR BEHALF

We work with third-parties such as schools, programs, and non-profit entities who participate in the Services with whom you may perform activities. We may use third-party vendors, service providers, and consultants to perform certain services on behalf of us or the Services, such as hosting the Services, requesting validation of service hours, designing and/or operating the Services’ features, tracking the Services’ activities and analytics, and enabling us to send you special offers or performing other administrative services. We may provide these schools, non-profits, and vendors with access to user information, including Personal Information, to disclose and confirm services performed in connection with that non-profit and to carry out the services that such vendors are performing for you or for us, respectively.

Third-party analytics, such as Google Analytics, and other service providers may set and access their own Tracking Technologies on your Device. They may otherwise collect or have access to information about you, including Personal Information. We are not responsible for those third-party technologies or activities arising out of them. However, some may offer you certain choices regarding their practices; information we have been informed of regarding such choices is available at the bottom of this Privacy Policy. We are not responsible for the effectiveness of or compliance with any third parties’ opt-out options.

C. TO PROTECT THE RIGHTS OF PGK AND OTHERS

To the fullest extent permitted by applicable law, we may also disclose your information if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety, or property of PGK or third parties (including through the enforcement of this Policy, our Terms of Service, and other applicable agreements and policies); or (ii) comply with legal and regulatory obligations (e.g., pursuant to law enforcement inquiries, subpoenas, or court orders), including lawful requests by public authorities to meet national security or law enforcement requirements.

D. WITH AFFILIATES AND DURING A BUSINESS TRANSFER

We may share your information, including your Personal Information, Demographic Information and Usage Information with future parents, subsidiaries, affiliates, and other companies under common control and ownership (“Affiliates”), but will only do so after providing you notice. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a merger, consolidation, restructuring, financing or acquisition of all or a portion of our business by another company, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.

4. Social Sharing Features

The Services may offer social sharing features and other integrated tools, which let you share actions you take on our Services with other media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the entities that provide these features.

PGK’s Services include ‘follow’ features that give you, the users, the ability to follow friends and organizations you are interested in. This feature allows you to be followed by your friends with your approval. You may reject follow requests or unfollow a user at any time.

5. Information Disclosed Publicly Or To Others

A. USER-GENERATED CONTENT AND PUBLIC INFORMATION

The Services may permit you to submit ideas, photographs, user profiles, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions, or other content, including Personal Information (collectively, “User Content”), such as on blogs and message boards. We may store, display, reproduce, publish, distribute, or otherwise use User Content online or offline in any media or format (currently existing or hereafter developed) and may or may not attribute it to you. Please think carefully before deciding what information you share, including Personal Information, in connection with your User Content.

Please note that PGK does not control who will have access to the information that you choose to make public and cannot ensure that parties who have access to such publicly available information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available on the Services or what others do with the information you share with them on the Services. We are not responsible for the accuracy, use, or misuse of any User Content that you disclose, or receive, from third parties through the Services.

B. NAME AND LIKENESS

We may also publish our non-profit partners’ name, likeness, and other information that is part of your User Content, and we may use the content, or any portion of the content, for advertising, marketing, publicity and promotional activities. For full terms and conditions regarding User Content, please review our Terms of Service.

C. PROFILES

A user’s profile page may be, by default, set up to display information such as the user’s display name, images, location (city/state/country), and optional information added by the user. Profile information is used by us primarily to be presented back to you, and edited by you when you access the Services, and to be presented to others permitted to view that information on the Services.

In some cases, other users of the Services may be able to view elements of your profile, such as your username and avatar. We may offer users the ability to manage their public profile through profile preference settings, the functionality and features of which are subject to change from time-to-time, so visit it frequently to confirm the settings reflect your then current preferences. We recommend that you do not post information or content as part of your profile that you are not prepared to make public. Users should carefully consider the use of such settings to improve information display options and to ensure the settings are properly set and functioning in the manner desired. Discretion and good judgment should be exercised when posting information or content as part of your profile.

6. Third-Party Content, Links To Third-Party Sites, and/or Third-Party Apps that Appear on the Services

Third-party applications may also be available via the Services. The owners of these applications (“Third-Party Owners”) may collect Personal Information and other data from you and may have their own policies and practices. We are not responsible for how Third-Party Owners or their applications collect or use your information. They may be tracking you across multiple sites and may be sharing the results of that tracking with us and/or others. These Third-Party Owners may have their own terms of service, privacy policies, or other policies and ask you to agree to the same. We are not responsible for these third-party privacy policies or the practices of Third-Party Owners. Be sure to review any available policies before submitting any personally identifiable information to a third-party application or otherwise interacting with them; exercise caution in connection with these applications.

The following third parties that collect information from you on, or in connection with, our Services have given us notice that you may obtain information on their policies and practices, and in some instances opt-out of certain of their activities, as follows:

PLEASE NOTE: We are not responsible for third-party policies or practices. We try to keep this information current, and will add to and subtract from the chart above as appropriate, but it is provided as a courtesy and may not be current or accurate. Please contact the applicable third parties regarding their privacy and data security policies and practices.

7. Analytics Services Provided by Others

We may allow others to provide analytics services on our behalf, across the web, and in mobile applications. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information. This information may be used by PGK and others to, among other things, analyze and track data, determine the popularity of certain content, and better understand your online activity. 8. Accessibility and Communications Preferences

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of registration. The Services may allow you to review, correct, or update Personal Information you have provided through the Services’ registration forms or otherwise, and you may provide registration updates and changes by editing your account information through the Services or by contacting us at info@projectgivingkids.org. If so, we will make good faith efforts to make requested changes in our active databases as soon as reasonably practicable (but we may retain prior information as business records).

With respect to our mobile and other applications (i.e., when we are the application publisher), you can prospectively stop collection of information by the application by uninstalling the application. You may use the standard uninstall process as may be available as part of your applicable Device or potentially via the appropriate application or app marketplace. Please note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons. When you edit your Personal Information or change your preferences on the Services, information that you remove may persist internally for PGK’s administrative purposes. If you would like to have your account removed or deleted, please email us your request at: info@projectgivingkids.org.

You may cancel or modify our e-mail marketing communications by following the instructions contained within our promotional emails or in some cases by logging into your Services account and changing your communication preferences. This will not affect subsequent subscriptions and if your opt-out is limited to certain types of e-mails the opt-out will be so limited. Subsequent or different subscriptions will be unaffected. Please note that we reserve the right to send you certain communications relating to your account or use of our Services, such as administrative and service announcements, and these transactional account messages may be unaffected if you choose to opt-out from receiving our marketing communications.

9. Transfer of Information to the U.S. and Other Countries

Our Services operate in the United States and are intended for users located in the United States. If you are located outside of the United States, please be aware that information we collect, including Personal Information, will be transferred to, processed, stored, and used in the United States. Therefore, we and our service providers may transfer, store, or access your information in jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction.

10. Children’s Privacy

We understand the importance of protecting children’s privacy in the interactive world. We are a general audience service and do not use the Services to knowingly collect personal information from children under the age of thirteen (13); children under the age of 13 require parental notice and consent under the Children’s Online Privacy Protection Act (“COPPA”). Children under 13 years of age should only use our Services under the supervision of a parent or guardian.

In the event that we become aware that we have collected personal information from any child, we will dispose of that information in accordance with COPPA and other applicable laws and regulations. If you are a parent or guardian and you believe that your child under the age of 13 has provided us with personal information without COPPA-required consent, please contact us at info@projectgivingkids.org.

A. THE CALIFORNIA ERASER LAW

If you are less than 18 years of age, you have the right to request removal of content posted to the PGK website and mobile app. To remove content, please send a request to info@projectgivingkids.org. Please be aware that removal does not ensure that the posted content or information will be completely or comprehensively deleted.

11. Security

We protect the security, integrity, and confidentiality of your personal information through the use of commercially reasonable physical, technical, and administrative safeguards. PGK stores data in a secure, cloud-based environment, and uses server authentication and industry-standard firewalls in an effort to prevent interference or access from outside intruders. We also require unique account identifiers, usernames, and passwords that must be entered each time users access the Services. Only those limited individuals who need access to our systems in order to maintain and improve the functionality of the Service, and its related communications, have access to the data.

12. Changes to the Privacy Policy

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). We will not use your previously collected Personal Information in a manner materially different than represented at the time it was collected without your consent. Please check back from time to time to review any changes.

13. Your Choices

A. ACCOUNT INFORMATION

You may update certain account information you provide to us at any time by logging into your account or emailing us at info@projectgivingkids.org. If you wish to delete or deactivate your account, please email us at info@projectgivingkids.org, but note that we may retain certain information as required by law or for legitimate business purposes. We may also retain cached or archived copies of information about you as long as needed for us to comply with our contractual obligations, employment obligations, and other business purposes, including global legal obligations to retain data.

B. LOCATION INFORMATION

When you first launch any of our mobile applications that collect precise location information, you will be asked to consent to the application’s collection of this information. You may also stop our collection of this location information by following the standard uninstall process to remove all of our mobile applications from your device.

C. COOKIES

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.

D. PROMOTIONAL COMMUNICATIONS

You may opt out of receiving promotional emails from PGK by following the instructions in those emails or emailing info@projectgivingkids.org. If you opt-out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.

E. MOBILE PUSH NOTIFICATIONS/ALERTS

With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

14. Your California Privacy Rights

How Do We Respond to Do Not Track Signals for California Residents. California Business & Professions Code Section 22575(b)(as amended effective January 1, 2014) provides that California residents are entitled to know how PGK responds to “Do Not Track” browser settings. PGK does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. Your presence on the website may be signaled to platforms, like Google Analytics, even if you have turned on a "Do Not Track" signal. We continue to review new technologies and may adopt a standard once one is created.
